Peter Fratangelo

Peter Fratangelo is an experienced litigation attorney whose practice encompasses all aspects of intellectual property litigation and counseling, as well as commercial litigation and business contract counseling. Peter believes that one size does not fit all when it comes to legal strategy, and provides legal advice and services tailored to each client’s situation. Peter works with each client to create and implement a legal strategy specific to the needs of that client, designed to meet the business objectives of the client, whether an IP strategy, a litigation strategy or a commercial strategy.

Peter has represented clients in diverse matters involving both cutting-edge and multi-billion dollar technologies across a

diverse range of industries in his fifteen years of experience as an attorney, including biotechnology, industrial chemistry and manufacturing, consumer electronics, lighting technology, video games, pharmaceuticals, mechanical engineering, aviation, and agricultural biotechnology. He has significant experience in Hatch-Waxman litigation and has represented pharmaceutical clients in a variety of areas including NSAID pain relievers, bio-pharmaceuticals used to treat anemia associated with kidney disease, and cancer treatment. Peter has also worked with leading industry professionals and distinguished academics in preparing expert reports in a variety of fields on critical issues of infringement and validity of patents.

Peter has both extensive litigation and transactional experience, including representing clients in contentious litigation, licensing negotiations, providing patent non-infringement and freedom to operate opinions of counsel, conducting due diligence of IP assets for mergers and acquisitions, and in creating both short and long term IP plans designed to both assert clients’ intellectual property rights and protect against assertions of other’s intellectual property. Peter has represented clients in pre-suit investigations, and managed all aspects of litigation from inception of suit through discovery, preliminary injunction hearings, summary judgment, pre-trial, trial, and appeal. Peter has represented clients in litigation in federal court and before the U.S. International Trade Commission in Section 337 Investigations. Peter has also represented clients in matters involving trade secrets, unfair competition, breaches of contract, and commercial torts.

Peter received his J.D. from New York University School of Law, where he graduated cum laude. Peter is admitted to practice in New York, Massachusetts, the U.S. First and Federal Circuits, and several U.S. District Courts. Peter has a degree in Biology from Tufts University, and was a Ph.D. Candidate in Molecular Biology at Cornell University – Sloan Kettering Institute prior to attending law school. Peter served as a federal court law clerk for the Honorable Ernest C. Torres, Chief Judge of the District of Rhode Island, and has worked at leading law firms Ropes & Gray, Clifford Chance, and Kaye Scholer during his legal career.
